Avoiding Contract Pitfalls

The role of conveyancers and real estate agents sometimes overlap - often with exchange of contracts. With this in mind, we see a need to keep agents (with whom we interact) fully informed of possible situations which could lead to either a purchaser having the right to rescind or a vendor being otherwise adversely affected.

Avoiding Contract Pitfalls

To fill this gap we have designed a 60 minute briefing session for agents to give them advice on:

1. Prescribed documents. Those documents often omitted from contracts which give a purchaser a 14 day right of rescission. We will also investigate some detail on the legislation around pool compliance certificates, when are they required and when other documents will suffice. Whether 149 certificates expire and discuss new legislation surrounding sewer diagrams.

2. Cooling-off period. Avoiding a cooling-off period that extends to actual completion of the sale and adding clauses to the contract that will help avoid these situations.

3. The 5% deposit. Why the clause requiring the payment of a further 5% (on default) is unenforceable and how to complete contracts when required.

There will also be an opportunity to ask questions of our team of specialist conveyancers and the briefing session qualifies for 1CPD Point (Category 1)!

Who Should attend?

News Sales Persons - wanting a grasp of the essentials

Sales assistants - responsible for assembling contracts prior to auction

Experienced sales persons - wanting an update on current legislation

Our next final sessions for 2018 will be held in Belrose on Tuesday 13th November, Thursday 22nd November and Tuesday 27th November. To reserve your seat please click on either of the dates above. Numbers are strictly limited to 10 people per session. Alternatively, if you would like Paul to visit your office to brief your entire team, please click here.
